Teleconference: Immigration Compliance – A Review of the Obama Administration’s Policies During the First Year and Looking Ahead to the Second Year

As the first year of the Obama Administration draws to a close, we are seeing an unprecedented level of immigration enforcement directed towards employers across the United States. Homeland Security Secretary Janet Napolitano recently affirmed the employer-focused enforcement strategy when she said that "employers need to be held accountable for maintaining a legal workforce." Indeed, it is no longer sufficient for employers simply to react to the government’s actions but must be proactive in developing a robust immigration compliance program or face serious consequences.

Please join the attorneys of Fragomen, Del Rey, Bernsen and Loewy, LLP in a look back at the enforcement initiatives that began in 2009, and a look ahead at how to prepare for the months and years ahead. The discussion will include:

    • I-9 audits by federal and state officials
    • Site visits by the Fraud Detection and National Security Office
    • Expansion of the E-Verify program, including obligations on federal contractors
    • Increased scrutiny of of visa petitions and related files
    • Legislative proposals impacting immigration enforcement

Michael D. Patrick, Partner, Fragomen, Del Rey, Bernsen & Loewy, LLP, New York, NY
